Finding the Right Venue

A probate, trust, or guardianship issue can’t be filed with just any court. Instead, there needs to be proper justification for filing with a particular venue. The rules around where a particular case can be filed are determined by the Texas Estates Code and Texas Trust Code.

While a Dallas estate and probate attorney can help you understand where you may have the ability to file, the matter is generally determined based on the residency of one of the primary individuals involved in the case. For instance, a guardianship case will likely be filed in the county where the incapacitated or minor person resides.

Having Proper
Standing

Having the right venue is not enough to file a claim with the court, however. Only those who have proper standing, or “interested people,” are permitted to file a claim. In most cases, this will mean someone who has a direct connection with the issue, but it may be slightly different depending on the facts of the case:

  • Guardianship. For situations involving a question of guardianship, it’s often a family member who has standing, but more broadly, anyone with a concern for the well-being of that person may be able to file.
  • Trusts. There is a narrow window of parties who are considered to have standing for a trust issue, such as the trust’s originator, the trustee, and any of the trust’s beneficiaries.
  • Estates. When an estate is in probate, family members and those who are named in the will have standing, along with anyone who may, like a creditor, have some kind of claim against the estate.

What Is Probate?

Probate is a process that an estate must pass through after a person dies unless the estate is relatively small. Several aspects of the probate process, most notably the asset distribution, will be guided by the deceased’s will. However, if the deceased failed to make a will before they passed, the process will provide a way of addressing the situation.

The probate process does present some concerns that people often try to avoid. One is the potential for the process to turn contentious more easily, particularly in high-asset cases. The probate process generally involves more exposure to expenses from something like taxation or creditors.

Additionally, the probate process is not private, which means someone’s estate and distribution will be available to the public. Unsurprisingly, many people choose to mitigate some of these issues through the use of trusts.
